Who is suited to Collaborative
Family Law?
- Neither
of you have commenced an application(s) in the Family Court
- You both
can foreseeably be expected to agree on all issues in dispute
- You both
are determined to behave in a respectful and ethical manner to each other
in working out the issues in dispute
- You both
value a negotiated settlement that is in the best interest of the children
and promotes shared or cooperative parenting
- You both
value a negotiated settlement that promotes a fair and equitable property
settlement
- You both
are committed to creative, future-focussed problem solving rather than blaming
for past behaviours
- You may
have already attempted mandatory mediation, but require the support or advice
of collaborative lawyers to help you resolve your dispute out of court
- High conflict
disputes that might not otherwise be successful in mediation (e.g., where
you both can overcome trust issues with each other, or willing/able to negotiate
with each other in a respectful and ethical manner)
- Complex
issues present and need discussion and decision making
